    It should be pointed out that playing the video games through that site is just as illegal as downloading copyrighted music and movies. Some might believe those games are so old as to be classified as “abandonware,” but the titles are still held as properties and continue to make money for their developers through re-releases such as an 80-game compilation, published this past holiday season by Atari, which included several of the games on that page.

    Neave Games has some of these as well. Indeed, some on the mentioned site were coded by Neave for the web.

    These games are too ubiquitous to be realistically protected under copyright law. Really, would you pay to play 20-year-old games?

    Scott, I don’t follow your “ubiquitous” argument. Certainly these games are quite popular and well-known, but why should the success of a product weaken its copyright? And while most people probably would not pay to play these older titles, their publishers continue to find at least a limited audience willing to purchase compilations of classic games.
